out a rule that franchisees are not joint employers. This should protect franchisors from excessive litigation and make it difficult, if not impossible, to unionize franchised businesses.

It will indeed protect franchisors from the waves of shyster shakedowns of phony class action claims, but it doesn't change the unionization issue. Unions were always able to organize any single franchise into a union. Their dream was to make all franchisees of a system unionized in a single campaign, but fortunately they never achieved it.
Franchisees are all different and their greedy, lazy attempt to wave a magic wand and create an $850,000,000 yearly income stream in dues without organizing business by business has been dashed,
However, the prize of that wet dream is so great that they will never give it up. If a Dem becomes president, it will be right back here in front of us again. Watch where MCD spends its PAC dollars.

Franchisees didnt dodge anything, as field office actions continually assert joint employer actions to bind everyone.
No, you dodged a bullet. Joint employer would have McDonald's in your stores involving themselves in ALL of your hiring decisions, scheduling, payroll, and on and on. Your business would no longer be a franchise but essentially a McOpCo with you paying the bills. Meanwhile, the unions would be empowered to organize your employees on a national basis.
Just because McDonald's corporate people still have the power to bully Owner/Operators doesn't make them a joint-employer.

I'm not going to approve any more comments on this topic. I'm getting strange comments that appear to union thugs pretending to be McDonald's Owner/Operators. If you are a McDonald's Owner/Operator and want to argue about this topic please send me an E-mail. There's not much to discuss here, it's a done deal (unless Bernie Sanders gets elected President).
And, if you're a McDonald's Owner/Operator who wants McDonald's to be proven to be a joint employer, you have a death wish.
